Confirmation/Cancellation

Reservations will be considered confirmed upon receipt of the 50% Reservation Deposit along with review and acceptance of these Terms & Conditions.  A valid Credit Card number on file is required on all reservations.  ALL CANCELLATIONS ARE SUBJECT TO A $25 CANCELLATION FEE.  IF RESERVATION IS CANCELLED WITH LESS THAN A 30-DAY NOTICE THE ENTIRE 50% DEPOSIT IS FORFEITED.  NO SHOWS OR CANCELLATIONS LESS THAN 24 HOURS PRIOR TO ARRIVAL WILL RESULT IN 100% FORFEITURE OF THE TOTAL RENTAL AMOUNT.  NO REFUNDS FOR EARLY DEPARTURE.

Rental Payments/Deposits

The RESERVATION DEPOSIT IS 50% of the TOTAL RENTAL AMOUNT and is due within 10 days from the date reservation is made (monthly guests, see “Multiple Monthly Stays” later in this section). Final 50% payment is due 14 days prior to arrival.  Full reservation payment is due at the time of booking if the arrival date is 30 days or less from date of booking.

Damage  Waiver Fee/Damages/Missing Items

A $50 non-refundable Damage Waiver Fee is required for all reservations and is included in the Transaction Fee.  The Damage Waiver Fee covers reported accidental or inadvertent damages that occur during the rental period in an amount up to $1,000.00.  If, upon check-in, there are any existing damages to the property or maintenance issues, the Guest must notify ERA Fernandina Beach Realty within two (2) hours of arrival (if you arrive after hours, report to the office the next business day).  If accidental or inadvertent damages occur during the rental period, the Guest must notify ERA Fernandina Beach Realty in writing within twenty-four (24) hours of the incident to be eligible for coverage.

 

The Damage Waiver Fee does NOT cover the following:

  1. Intentional damages caused by Guest or Guest’s invitees;
  2. Theft by Guest or Guest’s invitees;
  3. Willful or gross negligent behavior by Guest or Guest’s invitees;
  4. Removal of items from the property, including moving items to another property, by Guest or Guest’s invitees;
  5. Unauthorized entry into the homeowner’s closet by Guest or Guest’s invitees;
  6. Unauthorized animals (excludes lawful service animals) brought into the rental property by Guest or Guest’s invitees;
  7. Breach of any Rental Policies and Rental Agreements, including but not limited to, any fines imposed on Fernandina Beach Realty or on the homeowner imposed by any condominium or homeowner’s association, or any governmental or regulatory entity as a result of any violation of law, ordinance, rule or regulation;
  8. Extensive cleaning required at check-out caused by Guest or Guest’s invitees;
  9. Damages as a result of smoking by Guest or Guest’s invitees;
  10. Damages incurred as a result of excess occupancy or parking limits by Guest or Guest’s invitees; or
  11. Any other fines levied against the Guest or Guest’s invitees;

The Damage Waiver Fee is null and void upon Guest’s departure and any unreported damages discovered by ERA Fernandina Beach Realty will be the sole responsibility of Guest.  All unreported or non-covered damages will be processed onto the Guest’s credit card on file.  Previously listed items and additional charges exceeding the amount covered will be dealt with through conventional means of charging the Guest’s credit card on file for the amount of exceeded damages or replacement costs.  The Guest will be notified in writing of any excess damage. If the Guest fails to pay the amount due to ERA Fernandina Beach Realty for unreported or non-covered damages, ERA Fernandina Beach Realty reserves the right to exercise any legal rights available to pursue the amount owed from the Guest.  This Damage Waiver Fee is provided by and administered by ERA Fernandina Beach Realty and is NOT an insurance policy.

Methods of Payments

Payments may be made by cash, check or credit card (MASTERCARD and VISA only, Debit Cards are considered credit cards).  If you pay for your entire stay by cash or check, you may deduct the Non-Cash Fee from the total balance due.  Once the Non-Cash Fee has been deducted, should you make a non-cash payment (with exception of security damage deposit), this discount will be added back into the total amount due.  If paying by credit card, this cash discount will be included in your total due.  If paying by check, mail to the address above for your specific rental location.

Check-In Time

Check-in is 4:00pm.  We do our best to have your accommodations available by this time.  Peak times and holidays are especially difficult, so please understand we are working hard to have your unit available as soon as possible.  If you will be arriving after 5:00pm, please notify our office so we can make arrangements for you to obtain keys.

Check-Out Time

Check-out time is scheduled by 10:00am.  Late check-outs will delay our tight cleaning schedule and must be avoided.  Keys must be returned to the rental office.  Key drops are provided for early departures.

Check-Out Procedure

We ask that you leave the premises in the same general condition as it was found.  Please do the following upon check-out:

  1. Bag your garbage and take out to nearest dumpster or trash chute.
  2. Return all bedspreads to beds neatly
  3. Wash dirty dishes or place in dishwasher and start the wash cycle.  Do not leave dirty dishes in unit.
  4. Leave all furniture arranged as originally found.
  5. Check all drawers and closets for personal items.
  6. Lock all windows and doors.
  7. Return all keys and/or gate cards to our office.  There will be a $5.00 charge on all missing keys and a $50.00 charge for missing gate cards.
  8. Property inspections will be made after check-out.  There may be a charge if the above are not followed.

Free Internet

Some properties have complimentary internet services available.  These services are contracted with and provided by a third party therefore, we do not have control of the quality or availability of this service.  The service is not guaranteed and will not warrant discounts or emergency services.

Furnishings

Each rental property is privately owned and furnished according to the owner’s individual style.  Basic equipment and furnishings for a comfortable vacation are provided.  If you move furniture while occupying the property, you must return furniture to its original position prior to departure.  Failure to comply will result in a $50 fee

Linens/Towels & Supplies

Some of our houses and condominiums require you to bring your own bed and bath linens.  Check this website or ask your rental agent to verify if your property does or does not have linens.  Bed layouts are also available online.  You will need to bring your own beach towels and blankets, as linens are not to be removed from the unit. Linen rentals are available through Linens Away at (904) 261-6740.   A starter supply of paper products and soap will be supplied in your unit.  You will be responsible for additional supplies during your stay.  Rentals for cribs, high chairs and other baby necessities are available by calling Baby’s Away at (888)683-9030. Units may have locked closets for owner’s use only.  Such closets are not included in the rental of the unit.

Maximum Occupancy

Occupancy is STRICTLY limited to the number as shown on this website for your property.  Each property described on this Internet site indicates the number of persons allowed at any time, including children.  NO EXCEPTIONS.  If an excessive number of people are found in your unit, you will be asked to leave and NO REFUNDS WILL BE GIVEN.

Multiple Monthly Stays

The RESERVATION DEPOSIT for monthly guests renting for more than 1 month is 50% of the FIRST MONTH’S RENT and is due as mentioned in section labeled above “Deposits”.  The balance of your FIRST MONTH’S RENTAL amount is due 10 days prior to check-in.  Rent for each additional month is due the first of each month thereafter.

Occupancy Policy

It is the policy of ERA Fernandina Beach Realty, Inc. to rent to individuals who are 25 years or older.  We cannot allow a group defined as unrelated adults, high school students, college students or any other type situation not meeting the age requirements stipulated herein.  Should ERA Fernandina Beach Realty, Inc.’s personnel ascertain that a non-qualified group is occupying a property in violation of the age requirement; the group is subject to immediate termination of the agreement with no refund.  ERA Fernandina Beach Realty, Inc. reserves the right to refuse a requested rental; cancel any existing reservation; refund any deposit already received; and/or terminate current occupancy WITHOUT refund if the occupancy, in our opinion, is detrimental to the property and its owner, whom we represent.

Parking

The number of assigned spaces varies by building.  Parking requirements and limitations are listed in each property description.  Many condominiums only allow 1 vehicle and some condominiums require parking permits and cannot accommodate oversized vehicles.  We do have limited parking for extra vehicles or oversized vehicles off site.  Let your rental agent know if you have a need for additional parking.  Park in driveways only; avoid parking in yards, grass or landscape areas of the property.

Parties & Underage Drinking

Many of our rental properties are located in Mix-use neighborhoods that include both short-term guests and year round residents.  Be sure to observe all rules and regulations which are provided for each property.  Our houses or condos cannot be used for parties, weddings or large family reunions due to City Ordinance and Fire Code.  We will also not tolerate complaints of loud noises and underage drinking.  Any of these situations will result in EVICTION WITHOUT ANY REFUNDS BEING ISSUED.

Pets

PETS ARE ONLY ALLOWED IN THE DESIGNATED “PET FRIENDLY” PROPERTIES.  Check your property online to confirm it is Pet Friendly.  Pet Friendly properties require a non-refundable pet fee of $150 and Pet Addendum. Local boarding is available and many local facilities. If pets are found to be present in a NON PET FRIENDLY property, you will be asked to leave and no refund will be given and you will incur a $150 fee. (Pet Friendly properties:  301 Coral, 2158A SF, 2158B SF, 3780 SF, 1298 SF, 2340 SF, 1088 SF, 3095A SF Up, 3095B SF Dwn, 1719 NF, 1427 NF, 211 SF, 245 SF, 1423 NF, 2728 Forest, 424 Ocean, 623 Ocean, 2158 Cape S, 1916 SF).   

Smoking

Smoking is strictly prohibited in all of our rental properties.  You will incur a $150 charge for carpet cleaning and deodorizing if any evidence of smoking is found.

Substitution of Accommodations

If this property becomes unavailable prior to your arrival, from circumstances beyond our control (such as property sold to another owner, unforeseen construction, etc.), we will make every attempt to move you to a comparable property.  If a comparable property is unavailable, you will have the option of either selecting from our other available properties (an increase in rental fee may apply) or a refund of your total rents paid.  We will make every attempt to notify you as soon as possible if a substitution must be made.

Telephones

Telephones are available in some units for local calls only.  Long distance calls must be charged to a calling card or to your home phone.

Travel Insurance

Travel Insurance is available for your stay.  Please review the information regarding this insurance online at www.vacationrentalinsurance.com/330CERT.   Travel Insurance can help protect you from certain unexpected risks offering protection for Trip Cancellation, Trip Interruption and Travel Delay.  There is a “10-day free look” period.  You cannot cancel after the 10 day period and you may not cancel or purchase a policy after you have departed for the trip.

Disclaimer

The undersigned guest, their heirs, assigns and successors in interest for good and valuable consideration, agree(s) to indemnify, release and hold harmless ERA Fernandina Beach Realty, their heirs, assigns, successors and any Condominium Association (if applicable) in interest, from any and all liability for claims, actions, causes of action, damages, injuries or legal fees relating in anyway whatsoever to the use by the above referenced tenants and their guests located on the premises stated in this agreement.
